Meaningful and long-lasting progress in equity, diversity, and inclusion (EDI) continue to elude academics, practitioners, and policymakers. Extending Chater & Loewenstein's arguments to the EDI space, we argue that, despite conventional focus on individual-level solutions (i-frame), increasing EDI also requires a systemic focus (s-frame). We thus call for the design, testing, and implementation of multipronged s-frame interventions.

We consider the consequences of the essential multisemiotic character of scientific theories and show how this leads to even a single theory (...) being potentially 'internally incommensurable'. We then discuss Kuhn's lexicon-based approach to incommensurability and the problems associated with it. Finally we argue that this approach by Kuhn has interesting overlaps with the problem of meaning associated with multisemiosis, particularly the challenge of understanding the process of symbolization in scientific theories. Informed consent to medical intervention is fundamental in both ethics and law. But in practice it is often not taken seriously in developing countries. This paper provides an appraisal of informed consent practices in Bangladesh. Following a review of the ethical and legal principles of informed consent, it assesses the degree to which doctors adhere to it in Bangladesh. Based on findings of non-compliance, it then investigates the reasons for such non-compliance through an appraisal of informed consent practices in Bangladesh (...) and provides recommendations aimed at improving such practices. The significance of this paper lies in unveiling the interdependence between the ethical and legal traits of informed consent and their ramifications on strengthening the patient-oriented approach of duty to care. This article describes the aircraft image recognition system implemented using the phase correlation technique in Matlab environment. The phase correlation is computed by using the normalized cross-power spectrum between the database and the template test image. The main objective of this article is to develop methods for static analysis of aircraft images. An unknown fighter aircraft is recognized by comparing its static image with those from a database of images of aircraft. This work is a research initiative involving the use (...) of image processing techniques to detect three-dimensional aircraft object based on their 2D images, providing feedback information for strategic purposes. The phase correlation technique is found to give a better recognition result for the set of database and test images considered, compared with the invariant moments. The phase correlation method is also used in other areas such as image registration. Aircraft images used include those from AeroIndia 2011 held at Bangalore, India. (shrink)

Introduction Future HIV vaccine efficacy trials with adolescents will need to ensure that participants comprehend study concepts in order to confer true informed assent. A Hepatitis B vaccine trial with adolescents offers valuable opportunity to test youth understanding of vaccine trial requirements in general. Methods Youth reviewed a simplified assent form with study investigators and then completed a comprehension questionnaire. Once enrolled, all youth were tested for HIV and confirmed to be HIV-negative. Results 123 youth completed the questionnaire (mean age=15 (...) years; 63% male; 70% Hispanic). Overall, only 69 (56%) youth answered all six questions correctly. Conclusions Youth enrolled in a Hepatitis B vaccine trial demonstrated variable comprehension of the study design and various methodological concepts, such as treatment group masking. (shrink)

The concept of avidyā or ignorance is central to the Advaita Vedāntic position of Śȧnkara. The post-Śaṅkara Advaitins wrote sub-commentaries on the original texts of Śaṅkara with the intention of strengthening his views. Over the passage of time the views of these sub-commentators of Śaṅkara came to be regarded as representing the doctrine of Advaita particularly with regard to the concept of avidyā. Swami Satchidanandendra Saraswati, a scholar-monk of Holenarsipur, challenged the accepted tradition through the publication of his work Mūlāvidyānirāsaḥ, (...) particularly with regard to the avidyādoctrine. It was his contention that the post-Śaṅkara commentators brought their own innovations particularly on the nature of avidyā. This was the idea of mūlāvidyā or ‘root ignorance’, a positive entity which is the material cause of the phenomenal world. Saraswati argues that such an idea of mūlāvidyā is not to be found in the bhāṣyas (commentaries) of Śaṅkara and is foisted upon Śaṅkara. This paper attempts to show that although Śaṅkara may not have explicitly favoured such a view of mūlāvidyā, his lack of clarity on the nature of avidyā left enough scope for the post-Śaṅkara commentators to take such a position on avidyā. The exchange between Peter Park, Dan Flory and Leah Kalmanson on Park’s book Africa, Asia and the History of Philosophy: Racism in the Formation of the Philosophical Canon took place during the APA’s 2016 Central Division meeting on a panel sponsored by the Committee on Asian and Asian-American Philosophers and Philosophies. After having peer-reviewed the exchange, JWP invited Sonia Sikka and Mark Larrimore to engage with these papers. All the five papers are being published together in this issue.

The article is devoted to the model-theoretic study of the quantum plane kq[x,y], considered as an -structure, where is the language of representations of Uq. It is proved that the lattice of definable k-subspaces of kq[x,y] is complemented. This is deduced from the same result for the Uq-module M, which is defined to be the direct sum of all finite dimensional representations of (...) Uq. This paper investigates properties of \(\sigma \) -closed forcings which generate ultrafilters satisfying weak partition relations. The Ramsey degree of an ultrafilter \({\mathcal {U}}\) for _n_-tuples, denoted \(t({\mathcal {U}},n)\), is the smallest number _t_ such that given any \(l\ge 2\) and coloring \(c:[\omega ]^n\rightarrow l\), there is a member \(X\in {\mathcal {U}}\) such that the restriction of _c_ to \([X]^n\) has no more than _t_ colors. Many well-known \(\sigma \) -closed forcings are known to generate ultrafilters with finite Ramsey degrees, (...) but finding the precise degrees can sometimes prove elusive or quite involved, at best. In this paper, we utilize methods of topological Ramsey spaces to calculate Ramsey degrees of several classes of ultrafilters generated by \(\sigma \) -closed forcings. These include a hierarchy of forcings due to Laflamme which generate weakly Ramsey and weaker rapid p-points, forcings of Baumgartner and Taylor and of Blass and generalizations, and the collection of non-p-points generated by the forcings \({\mathcal {P}}(\omega ^k)/\mathrm {Fin}^{\otimes k}\). We provide a general approach to calculating the Ramsey degrees of these ultrafilters, obtaining new results as well as streamlined proofs of previously known results. In the second half of the paper, we calculate pseudointersection and tower numbers for these \(\sigma \) -closed forcings and their relationships with the classical pseudointersection number \({\mathfrak {p}}\). Author’s Introduction Intuitively, George Clooney could lose a finger and he would still be him. Also intuitively, he could not lose his humanity without ceasing to be altogether. So while he could have one less finger, he could not be other than human. These intuitions (...) suggest that there are two kinds of properties: on the one hand, there are essential properties and, on the other, there are accidental properties. Essentialism is the view that captures those intuitions and claims that some of an object’s properties are essential and some are accidental. Essential properties are often appealed to in metaphysical arguments. Consider the famous Goliath–Lumpl example. Goliath is a clay‐statue, and Lumpl is the piece of clay from which Goliath is made. Are Goliath and Lumpl the same entity, or are they distinct, despite coinciding in the same spatial region (at least for a period of time)? An argument in favour of their distinctness appeals to essential properties. Let s be Goliath’s shape. Lumpl’s current shape is therefore also s. It seems that Lumpl could lose its current shape and still exist. Yet, if Goliath – the statue – were melted, for instance, it would cease to exist. Behind this reasoning is the belief that having shape s is essential to Goliath but not to Lumpl. Goliath and Lumpl can therefore be distinguished by their essential properties. Consequently, and by Leibniz’s Indiscernibility of Identicals– according to which identicals cannot be distinguished – Goliath and Lumpl are distinct objects. The essentialist intuition appealed to in this argument is that shapes are essential to statues but not to pieces of clay. Of course, this particular argument – like any other – can be resisted. It is all the same a good illustration of how essentialism is put to work in metaphysics. A good understanding of the broad phenomenon of essentialism is therefore an unavoidable task, since the credit of a lot of metaphysical arguments partially depends on it. Although the topic has been studied for millenniums, the two papers that this guide accompanies are focused on contemporary issues in essentialism, and so will do this guide too. Naming and Necessity, Cambridge, MA: Harvard UP, 1972/1980. Another foundational work. With this book – which is, among other things, a defence of a Direct Theory of Reference – Kripke rescues, after Quine’s powerful attacks against it, and using the semantic rigidity of proper names, (Aristotelian) essentialism. Mackie, Penelope. How Things Might Have Been: Individuals, Kinds and Essential Properties. Oxford: Clarendon Press, 2006. An extremely valuable recent contribution to the field. Here, Mackie defends that, although essentialism is a real phenomenon, there are much fewer essential properties than is standardly believed, and labels this view ‘Minimalist Essentialism’. Beyond the intrinsic interest of the defence of Minimalist Essentialism, the book is also highly recommended for its clear reconstructions – and discussions – of some of the most influential essentialist arguments. In addition, the book’s bibliography is very comprehensive and updated, and it might be a useful resource for students. Plantinga, Alvin. The Nature of Necessity. Oxford: OUP, 1974. Yet another foundational work. Here, Plantinga offers his essentialist theory which, like Forbes’, also incorporates individual essences although of a very different sort from Forbes’. Plantinga believes in purely non‐qualitative individual essences, whereas Forbes’ aims at purely qualitative ones. The book is also excellent to provide a solid background to those unfamiliar with the topic. Roca‐Royes. ‘Essentialism vis‐à‐vis Possibilia, Modal Logic and Necessitism.’Philosophy Compass, 6/1 (2011): 54–64, doi: 10.1111/j.1747‐9991.2010.00363.x. This is one of the two papers this guide accompanies. It contains a comparative examination of two opposed responses to the problem of possibilia. One solution crucially appeals to individual essences and another – compatible with them, but not dependent on them – makes existence a necessary‐whenever‐possible property. Salmon, Nathan. Reference and Essence. Princeton: Princeton UP, 1981. Against what Kripke’s Naming and Necessity might have induced us to believe, Salmon’s Reference and Essence argues that essentialism cannot be derived from the Direct Theory of Reference. Our commitments to essentialism should therefore come from somewhere else. It also contains one of the most cited and influential arguments against the transitivity of the accessibility relation between worlds, which relies on flexible essential properties. John Carvalho’s Thinking with Images, an Enactivist Aesthetics argues that puzzling artworks can draw us into a special activity – thinking when we don’t know what to think – which is valuable because it takes us beyond our skills and understanding. Enactivism is the theory of mind that best explains such thinking. The book illustrates this proposal with four chapters that detail Carvalho’s highly personal or individual encounters with enigmatic works of art. I raise two concerns. First, the four illustrative (...) chapters say that they are enactivist, but they do not show this. The illustrative chapters detail considerations about the works that are not distinguished by a particular theory of mind and might fit with any number of approaches to works of art. The suggestion that the thinking presented in each chapter is skillful is not explained. Second, the book does not just focus on thinking when we don’t know what to think, it also claims that such thinking frees us from mere looking. But enactivism does not require us to deny that our engagement with particular works in their ‘concrete singularity,’ to use Carvalho’s term, is perceptual. If perception is richly integrated or even continuous with what we understand skillfully or cognitively – and enacted in one’s circumstances – this does not erase differences between perception and thought or between their functions. When we ‘think with’ an individual so that we are engaged with it in its concrete singularity, perception is involved either in the present or the past. There is no need to shunt perception or looking aside as life activities that are just rule-bound, just part of knowing what to think rather than part of our response when we don’t know what to think. The COVID-19 outbreak has ravaged all societal domains, including education. Home confinement, school closures, and distance learning impacted students, teachers, and parents’ lives worldwide. In this study, we aimed to examine the impact of COVID-19-related restrictions on Italian and Portuguese students’ academic motivation as well as investigate the possible buffering role of extracurricular activities. Following a retrospective pretest–posttest design, 567 parents reported on their children’s academic motivation and participation in extracurricular activities. We used a multi-group latent change score model to (...) compare Italian and Portuguese students’: pre-COVID mean motivation scores; rate of change in motivation; individual variation in the rate of change in motivation; and dependence of the rate of change on initial motivation scores. Estimates of latent change score models showed a decrease in students’ motivation both in Italy and in Portugal, although more pronounced in Italian students. Results also indicated that the decrease in students’ participation in extracurricular activities was associated with changes in academic motivation. Furthermore, students’ age was significantly associated with changes in motivation. No significant associations were found for students’ gender nor for parents’ education. This study provides an important contribution to the study of students’ academic motivation during home confinement, school closures, and distance learning as restrictive measures adopted to contain a worldwide health emergency. We contend that teachers need to adopt motivation-enhancing practices as means to prevent the decline in academic motivation during exceptional situations. (shrink)

Le droit enregistre, selon ses propres temporalités, les changements de valeurs, l'émergence de nouvelles inquiétudes, l'évolution des techniques et des connaissances. Depuis quelques années, nous assistons à une "demande" accrue de droit et de régulation juridique. Nous chercherons tout d'abord à repérer et identifier les nouveaux territoires du droit en montrant comment la norme juridique contribue en permanence à réinventer le réel, à fabriquer inlassablement la condition humaine, à se présenter sans cesse comme l'instituteur du social. Ce mouvement de juridicisation du social et du politique se traduit non seulement par une prolifération et une diversification de la règle de droit, mais également par un processus parallèle de judiciarisation qui voit un certain nombre de problèmes être traités par l'institution judiciaire (politiques de santé, de sécurité, phénomènes de criminalité internationale, etc.). Vaesen infers unique properties of mind from the appearance of specific cultural innovation – a correlation without causal direction. Shifts in habitat, population density, and group dynamics are the only independently verifiable incentives for changes in cultural practices. The transition from Acheulean to Late Stone Age technologies requires that we consider how population and social dynamics affect cultural innovation and mental function.

Kendall Walton explains pictures in terms of games of perceptual make-believe. Pictures or depictions are props that draw us to participate in games of make-believe where we imagine seeing what a picture depicts. Walton proposes that one imagines of one’s perceptual experience of the coloured canvas that it is a different perceptual experience. The issue is whether perception and imagination can combine the way Walton suggests. Can one imagine a perception to be different? To get a clearer understanding of the (...) unified perceptual-imaginative experience Walton posits, the paper turns to competing theories that explain perceptual experience in terms of contents, relations to objects, or both contents and relations. Walton appeals to theories of perceptual content and cognitive penetration. But it is also important to examine whether his view fits with recent theories that explain perception only in terms of relations or in terms of both contents and relations. The paper argues that Walton’s view is compatible with content theories of perception and can be defended from some objection once we look at the detail these theories offer. Walton’s view is not compatible with pure relational theories of perception but it can be explained by hybrid content-relational theories of perception that posit de re senses. (shrink)

Due to government imposing nationwide lockdown, higher educational institutes were quickly adopting to imbibe online learning medium. This research takes a qualitative thematic analytical approach to explore the facilitators and challenges to online learning from the perspectives of both learners and educators in higher education institutes. We begin this article by delineating the explanatory gaps left by prevailing gene‐focused approaches in our understanding of phenotype determination, inheritance, and the origin of novel traits. We aim not to diminish the value of these approaches but to highlight where their implementation, despite best efforts, has encountered persistent limitations. We then discuss how each of these explanatory gaps can be addressed by expanding research foci to take into accountbiological agency—the capacity of living systems at various levels to participate in (...) their own development, maintenance, and function by regulating their structures and activities in response to conditions they encounter. Here we aim to define formally what agency and agents are and—just as importantly—what they are not, emphasizing that agency is an empirical property connoting neither intention nor consciousness. Lastly, we discuss how incorporating agency helps to bridge explanatory gaps left by conventional approaches, highlight scientific fields in which implicit agency approaches are already proving valuable, and assess the opportunities and challenges of more systematically incorporating biological agency into research programs. The Introduction provides an overview of Kendall Walton’s make-believe framework for a variety of representations and his arguments that such representations are dependent on their social or historical context. Walton argues that diverse representations involve our capacities for imagination and make-believe with props; they overlap with the fictional. Focusing on make-believe with props explains paradigmatic representational arts such as paintings and novels, theater and film. But this perspective reaches beyond the arts: it explains pictures and photographs in general not only (...) artistic ones; stories in general as well as literary and performing arts; music; metaphors, and even the claims we make about fictional entities and existence. The first section explains the main points of the make-believe framework in Mimesis as Make-Believe, and it reconstructs Walton’s argument in “Categories of Art” that some aesthetic properties depend on the perceptible and historical categories of art to which a work belongs. The second section outlines Walton’s specific proposals about literary fiction, fictional characters, poetry, pictures, photographs, music and negative existential claims. These explanations are integrated with summaries of the papers. The third section examines Walton’s implicit view of two much-discussed issues: the ontology of art and definitions of art. This discussion clears away some misunderstandings of Walton’s contextualism or historicism and relates Walton’s work to Arthur Danto’s and Frank Sibley’s. (shrink)

Drawing on managerial discretion and conflicting institutional logics literature, this study investigates the relation between the personal sustainability behaviors of owner–managers and the corporate sustainability practices of SMEs. The research proposes a contingency model that assesses the moderating effects of perceived economic advantages and environmental hostility on this relationship. Based on linear hierarchical multiple regression analyses of a cross-sectoral sample of French SMEs, the results suggest a positive influence of the manager's PSB on the SME's CS practices that appears to (...) be differently moderated depending on the type of practice considered. The influence on environmental practices is fostered through the perception of economic advantages. The influence on workplace practices is only effective when the business environment is deemed benign and the influence on community practices is dampened by the perception of environmental hostility. Highlighting the trade-off between the manager's personal values and the SME's economic constraints, these findings contribute to a better understanding of the critical antecedents of sustainability in small businesses. According to logical theories of meaning, a meaning of an expression can be formalized and encoded in truth conditions. Vagueness of the language and individual differences between people are a challenge to incorporate into the meaning representations. In this paper, we propose a new approach to study truth-conditional representations of vague concepts. For a case study, we selected two natural language quantifiers most and more than half. We conducted two online experiments, each with 90 native English speakers. In the first (...) experiment, we tested between-subjects variability in meaning representations. In the second experiment, we tested the stability of meaning representations over time by testing the same group of participants in two experimental sessions. In both experiments, participants performed the verification task. They verified a sentence with a quantifier (e.g., “Most of the gleerbs are feezda.”) based on the numerical information provided in the second sentence, (e.g., “60% of the gleerbs are feezda”). To investigate between-subject and within-subject differences in meaning representations, we proposed an extended version of the Diffusion Decision Model with two parameters capturing truth conditions and vagueness. We fit the model to responses and reaction times data. In the first experiment, we found substantial between-subject differences in representations of most as reflected by the variability in the truth conditions. Moreover, we found that the verification of most is proportion-dependent as reflected in the reaction time effect and model parameter. In the second experiment, we showed that quantifier representations are stable over time as reflected in stable model parameters across two experimental sessions. These findings challenge semantic theories that assume the truth-conditional equivalence of most and more than half and contribute to the representational theory of vague concepts. The current study presents a promising approach to study semantic representations, which can have a wide application in experimental linguistics. (shrink)

The standards for translating texts in specialized fields have become particularly rigorous with the increasing complexity of material and growing demand for its translation. While translations simply aimed at communication and produced by machine translation are proliferating, the need for reliable and high-quality translations is also increasing. The demand for expert-dependable legal translation is higher than ever, requiring competence-based training in the field of legal translation. This paper describes a guided-task framework for developing subject area competence at the earliest stage (...) of an English–Arabic legal translation course. It presents the three most problematic phases of concept processing in legal translation in terms of: legal systems; branches of law; and genre-based phraseology. The approach presented below is part of a more general study that aims to describe the first course in a series of three graduate courses on legal translation, each of them motivated by a guided-task framework that has the aim of developing three specific competences in legal translation: legal concept processing => subject area competence; documentary research => instrumental competence; and legal rhetorics => communicative and textual competence. In this paper we intend to focus on the first course of legal concept processing as a key prerequisite for legal knowledge development. We illustrate the relevance of addressing specific variables when analysing legal concepts in the text that is to be translated, before proceeding to the information search and communication, according to established formulae and conventions. En este texto se aborda el vínculo entre la estructura narrativa de la memoria colectiva (Halbwachs, 2004b) y la dimensión hermenéutica de la ciudadanía (Valderrama, 2010), desde los hallazgos de la investigación denominada Configuraciones de memoria colectiva en participantes del Programa Prensa Escuela entre 2015 y 2019. Para estos efectos, se aplicó una metodología cualitativa, de diseño de revisión documental, y se analizaron los textos de jóvenes, recopilados en la publicación anual El Taller. Se identificó que los temas desarrollados en (...) las narraciones en los cuales se vincula la memoria colectiva y la ciudadanía son identidad y territorio, marcos comunes de pensamiento y reconstrucción del pasado. De esta manera, la narración facilita el reconocimiento de la realidad y sus problemáticas, toda vez que los jóvenes asistentes al Programa podían expresar su percepción del mundo, confrontar elementos de su entorno y darle lugar al otro. Estos textos adquieren resonancia en cuanto entra la hermenéutica a tender puentes para la comprensión del mundo y en el caso de la ciudadanía para la construcción de nuevos modos de convivir. This article explores gender inequities and sexual double standards in teens’ digital image exchange, drawing on a UK qualitative research project on youth ‘sexting’. We develop a critique of ‘postfeminist’ media cultures, suggesting teen ‘sexting’ presents specific age and gender related contradictions: teen girls are called upon to produce particular forms of ‘sexy’ self display, yet face legal repercussions, moral condemnation and ‘slut shaming’ when they do so. We examine the production/circulation of gendered value and sexual morality via teens’ discussions (...) of activities on Facebook and Blackberry. For instance, some boys accumulated ‘ratings’ by possessing and exchanging images of girls’ breasts, which operated as a form of currency and value. Girls, in contrast, largely discussed the taking, sharing or posting of such images as risky, potentially inciting blame and shame around sexual reputation (e.g. being called ‘slut’, ‘slag’ or ‘sket’). The daily negotiations of these new digitally mediated, heterosexualised, classed and raced norms of performing teen feminine and masculine desirability are considered. (shrink)

Inspired by the last major investigation of the subject by Hanna Pitkin over four decades ago, this ambitious volume fills a major gap in the literature by examining the future of representative forms of democracy in terms of present-day trends and past theories of representative democracy. Aware of the pressing need for clarifying key concepts and institutional trends, the volume aims to break down barriers among (...) disciplines and to establish an interdisciplinary dialogue among scholars. This study focuses on retraction notices from two major Latin American/caribbean indexing databases: SciELO and LILACS. SciELO includes open scientific journals published mostly in Latin America/the Caribbean, from which 10 % are also indexed by Thomson Reuters Web of Knowledge Journal of Citation Reports. LILACS has a similar geographical coverage and includes dissertations and conference/symposia proceedings, but it is limited to publications in the health sciences. A search for retraction notices was performed in these two databases using the keywords “retracted”, (...) “retraction” “withdrawal”, “withdrawn”, “removed” and “redress”. Documents were manually checked to identify those that actually referred to retractions, which were then analyzed and categorized according to the reasons alleged in the notices. Dates of publication/retraction and time to retraction were also recorded. Searching procedures were performed between June and December 2014. Thirty-one retraction notices were identified, fifteen of which were in JCR-indexed journals. “Plagiarism” was alleged in six retractions of this group. Among the non-JCR journals, retraction reasons were alleged in fourteen cases, twelve of which were attributed to “plagiarism”. The proportion of retracted articles for the SciELO database was approximately 0.005 %. The reasons alleged in retraction notices may be used as signposts to inform discussions in Latin America on plagiarism and research integrity. At the international level, these results suggest that the correction of the literature is becoming global and is not limited to mainstream international publications. (shrink)

Aesthetic properties figure prominently in our daily lives, our conversations and many actions we take. Yet theoretical disagreement prevails over their nature, their variety, their epistemic and metaphysical status. This overview highlights the heterogeneity of aesthetic properties and examines repercussions for explanation. Aesthetic properties belong to natural objects or scenes, to artworks in any medium, to artefacts and built environments across historical eras; and they draw a wide variety of responses such as our perceptions, emotions or imaginative thought. Historicism about (...) artworks carries over to at least some aesthetic properties that depend on facts of their broader historical context just as works do. One issue is whether aesthetic properties can be demarcated solely in terms of non-aesthetic properties. If not, explanations of aesthetic properties need to draw on other aesthetic notions such as aesthetic experience, attention, judgement or value. The paper examines several accounts of aesthetic value to show how they extend to aesthetic properties. The paper concludes with an overview of the current metaphysical debate between realists and non-realists about aesthetic properties. (shrink)

The context-based use of terminology and phraseology is one of the essential building blocks of legal translation. The contextual nature of both components has implications when it comes to designing resources that are adapted to the needs of translators. For Arabic legal translation, there are a multitude of different print and online resources available, however, they do not integrate the context-related parameter for term choice acceptability. In this article, we will describe the main features of certain bilingual legal dictionaries with (...) the English-Arabic and French-Arabic language pairs. We will then make a descriptive assessment of the tools available online, highlighting their limitations. Taking into consideration all the contextual parameters involved in making a translation choice, we will put forward the value of developing bilingual ontologies with Arabic. With the rapid expansion of information technologies, a move towards formalizing legal knowledge will help fill existing gaps in the representation of Arabic legal content and the retrieval of information, providing legal translators with a tool that provides specific details that will enable translators to make informed and relevant decisions, in addition to opening new research perspectives for Arabic legal translation. In recent years, the changing landscape for the conduct and assessment of research and of researchers has increased scrutiny of the reward systems of science. In this context, correcting the research record, including retractions, has gained attention and space in the publication system. One question is the possible influence of retractions on the careers of scientists. It might be assessed, for example, through citation patterns or productivity rates for authors who have had one or more retractions. This is an emerging (...) issue today, with growing discussions in the research community about impact. We have explored the influence of retractions on grant review criteria. Here, we present results of a qualitative study exploring the views of a group of six representatives of funding agencies from different countries and of a follow-up survey of 224 reviewers in the US. These reviewers have served on panels for the National Science Foundation, the National Institutes of Health, and/or a few other agencies. We collected their perceptions about the influence of self-correction of the literature and of retractions on grant decisions. Our results suggest that correcting the research record, for honest error or misconduct, is perceived as an important mechanism to strengthen the reliability of science, among most respondents. However, retractions and self-correcting the literature at large are not factors influencing grant review, and dealing with retractions in reviewing grants is an open question for funders. (shrink)

S'appuyant sur des exemples issus de l'étude de la Seconde Guerre mondiale ainsi que de l'histoire du passé récent dans les sociétés post-communistes, cet article tente de voir dans quelle mesure les modalités d'accès aux archives publiques peuvent être tenues pour responsables de phénomènes d'amnésie - ou d'hypermnésie - de la mémoire collective, de la fabrication de mythes et de légendes. Il est certain que sans l'accès aux archives du troisième Reich, Raul Hilberg n'aurait pu entreprendre son œuvre monumentale et (...) pionnière sur la destruction des juifs d'Europe. Pour autant, il est des domaines, notam­ment celui des comportements collectifs, sur lesquels l'archive est muette - à moins de bénéficier de ces formidables corpus que constituent par exemple les archives des polices politiques comme les dossiers de la Stasi. Toutefois, l'usage public de ce type d'archives peut poser problème et générer des batailles de mémoire. Lestés d'enjeux, les conflits de mémoire ne se résolvent certes pas à coup de preuves tirées des archives, mais la rétention de ces dernières favorise incontestablement l'élaboration de récits mythiques ou de « romans nationaux ».Drawing on examples from studies of the Second World War and from the recent history of post-Com­munist societies, this article attempts to discern how far rules of access to public archives may have been responsible for collective amnesia - or hyper-amnesia - and the emergence of myths and legends. What is certain is that without access to the archives of the Third Reich, Raul Hilberg would never have been able to undertake his monumental pioneering work on the destruction of Europe's Jews. And yet, there are areas, especially where collective behaviour is concerned, that cannot be fathomed through archives - short of having access to the extraordinary material represented by political police archives such as the Stasi files. However, public use of such archives can raise problems and generate conflicts over memory. Because they embody such a weight of issues, conflicts over memory cannot be resolved merely by pulling out evidence from an archive, but withholding such records most certainly fosters the emergence of mythical narratives and "national epics". Eight years since the Spanish statute on gender violence (Ley 1/2004) has been passed, it is time to assess its implementation. This paper deals with the proof of acts that are typified under that heading. In particular, it focuses on three issues. Firstly, it questions the admissibility of accepting the victim testimony as sufficient evidence to outweigh the presumption of innocence in favour of the accused. Secondly, it analyzes whether the Spanish Supreme Court doctrine on evidence in cases of gender (...) violence allows inferring such admissibility, and whether this is applicable to every case or only to a certain type. Thirdly, it tries to identify the consequences that can be attached to that admission. (shrink)
